At the federal level, there are not many benefits left that pensioners can take advantage of. But it’s useful to know about them because almost all “bonuses” from the state can only be received if you apply for them. The “declarative principle” applies - if you don’t ask, you won’t receive. We are talking about some tax breaks, reimbursement of travel expenses to the vacation spot of northern pensioners, as well as additional leaves for pensioners who continue to work. 1. “Zero” property tax

A great help to pensioners in our country is exemption from property taxes.

Who should

This benefit is provided to both non-working pensioners and those who continue to work.

“A pensioner receiving a pension assigned in the manner established by the pension legislation of the Russian Federation is exempt from paying property tax if he owns it,” says the Tax Code (Article 401, paragraph 10, paragraph 1, paragraph 4 of Art. 407 of the Tax Code of the Russian Federation).

You can apply for a property tax deduction at the tax office at your place of residence.

Terms of service

The tax is zeroed for the following types of real estate:

  • apartment or room;
  • House;
  • garage or parking space in a shared garage;
  • premises used as creative workshops, ateliers, studios, non-state museums, galleries, libraries;
  • utility buildings whose area does not exceed 50 square meters. m and which are located on land plots provided for private farming, summer cottages, and individual housing construction.

The benefit is provided in respect of one taxable object of each type.

If, for example, a pensioner owns an apartment, a house and a garage, he is fully exempt from paying tax on all this property. And if a pensioner has two apartments and a house, then he has the right to a tax break for the house, as well as only for one of the apartments. You will have to pay tax for the second apartment.

Where to go and how to get it

An application for a tax benefit and a document giving the right to receive it must be submitted in person to the tax office at the location of the property (clause 6 of Article 407 of the Tax Code of the Russian Federation). The document confirming the right to the benefit is a pension certificate.

If, as of December 31, 2014, you were granted a property tax benefit in accordance with Law No. 2003-1 dated December 9, 1991, then you have the right not to re-submit to the tax authority an application and documents confirming the right to the benefit (Part 4 of Art. 3 of the Law of October 4, 2014 No. 284-FZ).

If a pensioner is the owner of several taxable objects of the same type (for example, three apartments), before November 1 of the calendar year in which he received the right to the benefit, he must submit an application to the tax office and indicate which apartment the tax should not be levied on. That is, the owner himself chooses the property to use his right to the benefit. It is clear that it is beneficial for him to “exempt” the most expensive apartment from tax, but there may be some other considerations.

True, if the owner does not submit such an application to the tax authorities, they themselves are automatically obliged to “zero out” the tax on the object for which they had to pay the most (clause 7 of Article 407 of the Tax Code of the Russian Federation).

2. If real estate appears

This benefit is relevant, unfortunately, only for working pensioners who receive a salary and, therefore, pay income tax (such tax is not levied on pension payments in our country). But it can also be used by non-working pensioners who recently retired and had income (still worked) in previous years before purchasing real estate.

The benefit is that the pensioner has the right to carry over the balance of property deductions for personal income tax to previous tax periods.

Who should

For example, a pensioner bought or built a house or other real estate. After registering ownership, he can return part of the money spent through a property tax deduction. Simply put, you will be partially refunded the amount of income tax paid before you became the owner of the property.

Terms of service

A property deduction can be obtained if:

  • a residential building, apartment, room was built or purchased;
  • share(s) in any of these types of real estate;
  • a plot of land was purchased for individual housing construction;
  • the land plot on which the purchased residential building is located (or a share in it) is purchased.

In addition, property deductions apply not only to expenses associated with the purchase or construction of real estate, but also to the payment of interest on relevant targeted loans (loans).

If the owner has a house, an apartment, and a garage, he is exempt from property tax on all real estate properties

It is allowed to receive a deduction for three tax periods (in other words, three years) preceding the period in which the carryover balance of property deductions was formed (clause 10 of Article 220 of the Tax Code of the Russian Federation).

How much money will be returned

The amount of property deduction depends on the amount of expenses for the purchase (construction) of housing and the amount of interest paid on the loan taken for the purchase or construction. In this case, the maximum deduction amount cannot exceed 2 million rubles. and 3 million rubles. (Clause 1, Clause 3, Clause 4, Article 220 of the Tax Code of the Russian Federation).

Important detail: limit of 3 million rubles. property tax deduction for the cost of paying interest on a loan taken for the purchase (construction) of housing is applied to loans received from 01/01/2014 (clause 4 of article 2 of Law dated 07/23/2013 No. 212-FZ).

3. Exemption from income tax

Personal income tax is not charged on some pensioner income.

Not subject to taxation:

  • the amount of pensions under state pension provision, insurance pensions, a fixed payment to the insurance pension (taking into account its increase) and funded pension;
  • social supplements to pensions paid in accordance with the legislation of the Russian Federation and the legislation of the constituent entities of the Russian Federation (clause 2 of Article 217 of the Tax Code of the Russian Federation);
  • the amount of payment at the expense of the organization’s own funds for the cost of sanatorium vouchers, as well as the cost of treatment and medical care for former employees who retired due to disability or old age (clauses 9, 10 of Article 217 of the Tax Code of the Russian Federation);
  • gifts, amounts of financial assistance provided by employers to their former retired employees;
  • the amount of payment (reimbursement) for the cost of medicines by employers to their former employees (age pensioners).

For each of these grounds, the amount of tax-free income is no more than 4,000 rubles. for the calendar year (clause 28 of article 217 of the Tax Code of the Russian Federation).

4. Additional leave

We are talking about unpaid leave provided to working pensioners.

Who should

The employer is obliged, at the request of the employee, to provide leave without pay (Article 128 of the Labor Code of the Russian Federation):

  • participants of the Great Patriotic War - up to 35 calendar days a year;
  • for working old-age pensioners (by age) - up to 14 calendar days per year;
  • for working disabled pensioners - up to 60 calendar days per year.

5. If you need to go on vacation

Compensation for travel costs to and from your vacation destination

Who should

According to the federal law on guarantees for northerners, compensation is provided to non-working pensioners who receive an old-age or disability insurance pension and live in the Far North or equivalent territories (Article 34 of the Law of February 19, 1993 No. 4520-1).

Terms of service

Travel is paid once every two years and only within the territory of Russia.

Where to go and how to get it

The benefit is provided by the territorial body of the Pension Fund of the Russian Federation, so you need to contact your Pension Fund branch at the place of residence where your pension file is located.

There are two options for receiving compensation: directly receive tickets or first buy them yourself, and then return the money spent (clauses 2, 3, 6 of the Rules for compensation of expenses for paying the cost of travel to pensioners, approved by Decree of the Government of the Russian Federation of April 1, 2005 No. 176) .

How to apply

1. If you want to receive travel tickets in advance, before departure, you will need to document your upcoming stay in a sanatorium, holiday home, camp site or other holiday destination. Such a document can be a voucher, course, accommodation agreement, etc.

2. You can also receive monetary compensation after your vacation. In this case, you will need to attach air or train tickets to your application for reimbursement of travel expenses.

There are no restrictions on carriers: these can be both state and private transport companies. But only tickets for travel within the territory of Russia, including Crimea, are paid (clauses 7, 9 of Rules No. 176; clauses 13, 19 of the Administrative Regulations, approved by Order of the Ministry of Labor of Russia dated October 22, 2012 No. 331n).

6. State social assistance

State social assistance is provided to pensioners whose average income does not exceed the subsistence level established in the region where they live. General rule: monthly social supplement to pension up to the level of the regional subsistence minimum if the pensioner does not work. In addition, the law specifies certain categories of citizens who have the right to receive such assistance (Article 7 of Law No. 178-FZ of July 17, 1999).

State social assistance is assigned on the basis of a pensioner’s application by a decision of the social protection authority at the place of residence or place of stay of the pensioner. Some types of social assistance are prescribed by the territorial bodies of the Pension Fund (Parts 1, 2, Article 8 of Law No. 178-FZ of July 17, 1999). 7. Regional benefits

There are other tax and “material” benefits for pensioners, which may be established by regional or local legislation. For example, benefits for paying transport tax (Article 356 of the Tax Code of the Russian Federation), benefits for paying land tax (clause 2 of Article 387 of the Tax Code of the Russian Federation), benefits for paying for public transport, paying for utilities and others. Example of calculating property deduction

Let’s say a pensioner, including a working person, purchased and registered ownership of a house worth 2 million rubles in 2016. The total amount of the property deduction due to him will be this amount - 2 million rubles.

This means that the tax service can return to him the amount of income tax paid on his income in the amount of 2 million rubles. Since the income tax rate is 13%, the refundable amount will be 260 thousand rubles. (RUB 2,000,000 x 0.13).

Let’s say the income (salary) of the property owner will be 300 thousand rubles in 2013, 320 thousand rubles in 2014, 410 thousand rubles in 2015, 508 thousand rubles in 2016. Consequently, a pensioner in 2017 will be able to receive a deduction for 2016, and transfer the balance to 2013, 2014 and 2015 in the full amount of available income.

He is entitled to a refund of 200 thousand rubles. or, respectively, for the indicated years: 39 thousand rubles. (RUB 300,000 x 0.13), RUB 41.6 thousand. (RUB 320,000 x 0.13), RUB 53.3 thousand. (RUB 410,000 x 0.13), RUB 66 thousand. (RUB 508,000 x 0.13).

The balance of the deduction in the amount of 462 thousand rubles. What benefits are available to pensioners in the Moscow region? The liver of social support measures for pensioners includes tax, medical and social benefits, discounts on housing and communal services.

Separate benefits are provided for working pensioners and elderly people (over 80 years old).

Tax benefits for pensioners

Pensioners are exempt from paying property tax. They may not pay it for real estate that they own.

This is, for example, a living space, a country house, a garage, a parking lot or other buildings.

The benefit is provided for one object of each type. So, if a pensioner has several apartments, then he can receive tax breaks for only one of them.

The procedure for obtaining property benefits is of an application nature.

Without submitting an application for exemption from property tax to the Tax Inspectorate and presenting a pension certificate, receipts with demands for payment will continue to be sent to the pensioner.

A former military personnel also has the right to receive an exemption from property tax.

In general, pensioners in the Moscow region do not have tax benefits for paying transport tax. With the exception of WWII veterans and disabled people of groups 1 and 2.

Land tax benefits for pensioners are determined at the municipal level.

The fact is that this tax relates to local jurisdiction and there is no general benefit for the entire Moscow region.

Thus, in the Pavlovo-Posad district, a land tax benefit is provided for single pensioners; in Korolev, owners of 12 acres and smaller plots are exempt from paying half the tax; in Ivanteevka, a complete tax exemption is provided for the poor.

Personal income tax benefits for pensioners

Persons of retirement age are exempt from personal income tax on some payments.

This is a pension, a social supplement to it, compensation for the cost of sanatorium treatment, a tax refund for treatment or the purchase of medicines, obscenities. assistance (within 4000 rubles).

At the same time, personal income tax continues to be withheld from the salaries of working pensioners on a general basis.

Pensioners are entitled to tax deductions when purchasing a home, both using their own savings and using a mortgage.

Limits on deductions for the purchase of housing are now 2,000,000 rubles.

This means that a pensioner can get back 260,000 rubles. (2,000,000*13% personal income tax).

If he took out a mortgage loan, then the limit increases to 3,000,000 rubles.

Benefits for payment of housing and communal services

Residents of the Moscow region of retirement age have the right to expect exemption from various payments for utility services.

Thus, they are exempt from paying for garbage collection services; they are compensated for part of the funds that goes to pay for city communications (up to 190 rubles monthly).

Benefits for military pensioners under this article are provided only for those citizens whose utility bills account for more than 10% of their family income.

They are entitled to a subsidy to pay for housing and communal services bills after contacting the Center for Housing Subsidies.

Pensioners can get help with gasification of their homes.

Benefits for military pensioners who also have the status of a labor veteran include a 50% discount on utility bills, radio, collective antenna, and garbage removal.

Benefits for working pensioners

Working pensioners have the right to count on additional benefits. Thus, they are entitled to additional annual leave, but without maintaining their salary.

For WWII participants and disabled people it can reach 60 days and 14 days for pensioners. The employer does not have the right to refuse them if a corresponding application is received.

Although working pensioners, according to the new rules, do not receive pension compensation, its size increases annually taking into account the employer's contributions made for him during the year.

Pensioners are exempt from the legally required two weeks of work upon leaving work.

To do this, you must indicate “retirement” in the reason for dismissal column.

If the reason for dismissal is indicated as “own desire,” the employer has the right to oblige the pensioner to work for 2 weeks.

Otherwise, labor legislation does not provide for any special privileges for pensioners.

They are not entitled to a reduced working day, exemption from the probationary period and business trips, and they have no advantages over other candidates at the interview other than work experience.

Benefits for medical care

Pensioners are entitled to free services in state and municipal health care institutions.

Old-age pensioners can receive a discount on the cost of medicines.

But for this, the following conditions must be simultaneously met: the citizen receives a minimum pension, undergoes outpatient treatment and the medicine is purchased with a prescription.

Then you can get a discount of up to 50%, and for some diseases - up to 100%.

Persons over the age of 60 are entitled to medical examination once every three years, WWII veterans - once a year. Disabled veterans have the right to spend the summer with a free voucher to a sanatorium.

Other persons of retirement age are entitled to compensation for travel to places of recreation and sanatoriums once every 2 years. Only working pensioners are deprived of this preference.

To obtain compensation, you must contact the Pension Fund of the Russian Federation, presenting travel tickets and vouchers.

Every year, pensioners can get a free flu vaccination at a local clinic.

Working pensioners can count on free production and repair of dentures (except for those made from metal-ceramics and precious metals).

Social service

Pensioners who find themselves in a difficult financial situation can count on financial support from the USZN.

They can receive help not only with money, but also with food, clothing, hygiene items, and other essential items.

As for the social supplement to pensions, it is only due to residents of Moscow, and in the Moscow region it is not provided.

A number of areas of social support are provided to residents of the Moscow region using a social card.

Its holders have access to free travel on the metro, discounts when paying for urban and suburban transport, various discounts and additional bonuses in stores that are partners of the program.

Benefits for pensioners over 80 years of age

Pensioners who are over 80 years of age are entitled to additional benefits. Thus, the size of their insurance portion of their pension doubles.

No additional documents are required for this; recalculation will be done automatically.

They have the right to receive free medical, psychological, and social assistance, including accommodation in boarding homes.

Pensioners can also count on free legal advice

If they have problems with housing, they can be provided with a social apartment from the state.

Elderly people are entitled to constant assistance in the form of a certain set of food products, the distribution of which is the responsibility of Social Security. protection.

For citizens over 80 years of age, a guardian from among the immediate family or strangers may be appointed.

The guardian himself will be paid money for his services. In this case, guardianship will be included in the insurance period for calculating the pension.

In accordance with the new pension reform and the legislation of the Russian Federation, and more precisely with the federal law “On Insurance Pensions”, starting from 2019, all male citizens over the age of 65, and women aged from 60 years old. This category of people are pensioners.

Additional leave for retirees at work

Unfortunately, pensioner status does not entail the right to additional vacation days.

However, a significant benefit for a working old-age pensioner is the right to additional leave at his own expense. The Labor Code establishes that a pensioner who continues to work has the right to receive such leave for a period of 14 days at any time convenient for him, and the obligation of the employer is to provide such leave to the employee upon his written application.

Additional vacation periods apply to certain categories of citizens:

  • for working WWII participants, leave at their own expense can be granted for 35 days,
  • for disabled people, unpaid leave can be up to 60 days

The calendar days provided by law can be used either at a time or in parts, depending on needs, divided into 1 year.

Working after receiving a pension leads to an increase in pension

In any of the cases provided for by law of concluding an employment contract with a pensioner who has decided to start working again, the employer will be obliged to make monthly mandatory insurance contributions towards the funded pension of this person.

Speaking on this topic, it should be noted that in this case, a pensioner who went to work has an advantage over his non-working acquaintances and other pensioners. This is due to the fact that his old-age pension will be indexed.

Firstly, for a non-working pensioner, as a rule, the insurance pension and a fixed (basic) payment from the state will be indexed for the most part. Secondly, his funded pension will increase solely due to the investment of its management company or pension fund in any market transactions, which today may not only not bring any benefit to the money accumulated during the insurance period, but may even cause certain material losses, since investing in modern economic conditions is not an absolutely safe way to make a profit.

At this time, the working pensioner will also receive investment interest on his pension account, but he will also increase the amount from which this interest will be taken due to mandatory insurance contributions, which will ultimately lead to his total old-age pension during the next indexation it will increase by a higher rate. It should be noted here that for indexing in this direction, it is necessary that insurance premiums were paid by the pensioner for a full 12 months continuously. This countdown begins from the day the labor pension is calculated.

From 2015, through employer contributions from the salary of a working pensioner, points will be credited to the pensioner’s account in an amount of no more than three in one year.

However, not everything is so rosy. At the end of 2015, a law was passed to abolish the indexation of pensions for working pensioners. Thus, from 2016, working pensioners will continue to receive a pension, but it will not increase. After the pensioner is dismissed from work, the pension will be recalculated taking into account indexation.

Social benefits for working old-age pensioners

Meanwhile, the current regulatory legal acts require that the pensioner not work is a mandatory condition for providing benefits for pensioners. That is, there are a number of benefits that are not available to working pensioners.

What are working pensioners deprived of compared to their non-working compatriots?

A significant deprivation for working pensioners is inability to receive compensation to the vacation spot and back. It is worth noting that non-working pensioners have this right. Read more about how to receive compensation for travel to a vacation spot in our article.

For example, In Moscow and the Moscow region, there is a provision that all registered and non-working pensioners in a given area can undergo free sanatorium-resort treatment by contacting the social protection authorities with a corresponding request. Also, for example, in a number of large regions of the country there is a law that a non-working pensioner, when making a long trip to undergo treatment at a resort, sanatorium, etc., has the right to ask for reimbursement of expenses incurred for travel, either in the form of direct monetary compensation for the expenses spent amounts, and in the form of travel tickets.

Working pensioners are not entitled to a social supplement to their pension

Pension legislation provides for the payment of a social supplement for pensioners in the event that the pensioner’s total monthly income (and it includes pensions and various social benefits) is less than the pensioner’s subsistence level in the region of his residence.

Meanwhile, the legislation establishes that social supplements are paid only to non-working pensioners. When applying for a job the payment of the social allowance automatically stops, and the pensioner does not receive them for the entire time he is working, and after that if, due to certain circumstances, his pension begins to correspond to the subsistence level. That is, for working pensioners, even if their pension is below the subsistence level, they are not entitled to pay a social supplement.

In this regard, it is impossible to guarantee that his total income will be at the same level or higher, since he can get even the lowest paid job.

To date, no documents for receiving a pension upon reaching retirement age and continuing active work have been established at the state legislative level; the package that is submitted to the Pension Fund of the Russian Federation is the same as for pensioners who have decided to retire. However, it must be remembered that it is imperative to notify your employer that he does not have the right to stop making mandatory insurance contributions to the funded pension just because the person has reached retirement age.

Is it profitable to continue working after retirement?

As can be seen from all of the above, today it is impossible to give an unambiguous answer to how profitable or not it is beneficial for a person who has retired to continue his working activity. On the one hand, this brings an undoubted material increase to his general financial situation, but on the other hand, he is not sufficiently protected from employers due to his age, since he is subject to the general provisions of the Labor Code.

It should also be noted that while he is working, he will not be able to receive some privileges from the state, and use some of the benefits that are provided exclusively to non-working pensioners. However, on the other hand, if there is a good salary, the need for this kind of benefits may not arise at all, and at this time the funded part of the pension will increase, and when a person decides not to work, he will receive a higher pension than those citizens who did not continue their labor activity after reaching the age limit and went on an old-age pension.

Tax benefits

  1. Old-age pensioners have the right not to pay property taxes. This applies to real estate owned by a pensioner. Items covered by the deduction include:
    • living space (house or part of a house, apartment, room);
    • dacha (also dacha or land plot);
    • garage or parking lot;
    • other buildings not used for profit (working studios, private museums).

In order to take advantage of the social support measure, you need to write an application either in free form or in a specific form. All this must be explained to the tax office at your place of residence. The right not to pay tax is granted for one or more of each type of real estate.

  1. Old-age pensioners are exempt from paying income tax on funds received as:
    • old age pensions, social supplements to pensions;
    • payment of the cost of resort and sanatorium vouchers;
    • payment for medical care or treatment of a pensioner;
    • refunds for payment for medicines;
    • financial assistance paid by a former employer to a pensioner, not exceeding four thousand rubles.

Regional benefits

In addition to federal social support measures, residents of Moscow and the Moscow region have the right to take advantage of an additional package of measures established by the government of the Moscow region.
